Servers.com (hereinafter “SERVERS”), is the brand name under which various independent SERVERS companies operate. Each of those companies is a separate and distinct corporate entity that provides services in a particular geographic area. To do business with a SERVERS company, you must enter into a contract with the relevant SERVERS entity. Each SERVERS company has its own contract documentation for services and products. For all companies, the contract documentation generally consists of the Internet Services Masters Agreement, General Conditions, Policies, the Services Specification and the Support and Service Level Schedule. We do not sell your personal information in compliance with the California Consumer Privacy Act (CCPA). As a “Service Provider” as defined in the CCPA, SERVERS will not sell, retain, use or disclose Personal Information for any purpose other than as set out in an agreement with our customer or as otherwise permitted or required by the CCPA.
The General Terms & Conditions shall apply to all quotes and orders related to the provision of services and/or products by a SERVERS company, to the provision of services by SERVERS, to the provision of products by SERVERS, and to any agreements or other legal relationships between SERVERS and any customer resulting therefrom or in connection therewith. The SERVERS Service Specification Schedule sets out the specifications of services provided by SERVERS, and also details SERVERS’s obligations in connection with such services. You can read the Services Specification here: SERVERS Services Specification
The SERVERS Support and Service Level Schedule sets forth the performance metrics such as service levels, response times, service windows and availability of services provided by SERVERS. In addition, this Support and Service Level Schedule defines the service credits that a SERVERS customer may be eligible to, in case SERVERS does not meet the agreed performance metrics. Contracts with SERVERS are on the basis of our General Terms & Conditions and subject to additional annexes and Order forms.
If any controversy or dispute arises in connection with this Agreement, the Services or your use of SERVERS's services, such controversy or dispute shall first be presented for resolution by SERVERS to you. This Agreement and all matters arising there from or connected therewith are governed by the laws of the Netherlands to the exclusion of the provisions of the UN Convention on Contracts for the International Sale of Goods. The competent courts of Amsterdam, the Netherlands, shall have exclusive jurisdiction to hear and determine any suit, action or proceedings, and to settle any disputes, which may arise out of or in connection with this Agreement or other agreements or other legal relationships resulting there from.
